Major Credit Bureau Listings- how/why they happen

The National Credit Regulation Act 34 of 2005 became law in July 2007. The National Credit Regulator has ensured that all credit providers and credit bureaus are conversant with this law and the rights of the consumer, yet we still have the majority of the credit providers taking advantage of the consumer’s lack of information and deliberately transgressing the law.

Default Listing

 A default is listed on your profile if you have failed to pay a debt and failed to respond to demand letters.

Trace Alert

 A Trace Alert is listed when a credit provider cannot contact you and they want to get your attention.

Judgement

A judgement is granted by the court of law upon application by the credit provider for unpaid debt.

Administration

Administration order is a voluntary court granted judgement.

 
Normal Debt Review

 Debt Review is also a voluntary application by the consumer who cannot afford to maintain their credit obligations and wants to avoid legal action by using a Debt Counsellor to negotiate new payment arrangements with credit providers.

Court Granted Debt Review

Same as normal debt review but only granted by the court when one or all credit providers do not agree with the payment restructuring proposal.

CREDIT BUREAU CLEARENCE PROCESSES

The National Credit Regulator has ensured that all credit providers and credit bureaus are conversant with this law and the rights of the consumer, yet we still have the majority of the credit providers taking advantage of the consumer’s lack of information and deliberately transgressing the law.

DEFAULT CLEARENCE PROCESS

Your credit report is a record of your payment behavior. It tracks all your accounts and indicates where, over a period of two years, you have missed payments or gone into arrears on an account. Then after two years, this adverse information simply disappears. Right? Yes and no, your credit report contains all the positive, as well as negative information about your payment behavior. In addition, it includes information which may, or may not be considered negative by a credit provider. Some of this information may remain on your credit report for a longer or shorter period. A court judgment, for example – where a court issues an instruction to you to pay an outstanding amount – will remain on your credit report for five years. If you pay the full amount owed before that time, the judgment will be removed from your credit report as soon as the credit bureau receives either proof of payment from the credit provider or a valid court order rescinding the judgment. It is therefore vitally important that consumers who have had judgments against them and have paid the outstanding judgment debt, check their credit reports to ensure that this negative information no longer remains on their credit record. It is important to remember however that judgment debt is usually higher than the original amount owing. This is because it includes the original debt plus any other costs that may have accrued, including interest and legal charges.
